Terms of Service

1. Purpose
These Terms of Service (hereinafter "ToS") govern the use of the Simio mobile application and website (hereinafter "the Service"), published by Simio. By using the Service, you accept these ToS in their entirety.
2. Service Description
Simio is a platform that allows users to purchase, activate, and manage eSIM data plans for international use. The Service includes:
- Browsing an eSIM plan catalog by country and region
- Purchasing data plans via secure payment
- Activating eSIMs via QR code or activation code
- Real-time data usage tracking
- Managing active and archived eSIMs
- Topping up existing plans
3. Registration and Account
To use the Service, you must create an account by providing accurate and up-to-date information. You are responsible for the confidentiality of your login credentials and all activities carried out from your account.
You can register by email and password, or through Google or Apple authentication services. You must be at least 16 years old to use the Service.
4. Device Compatibility
Using eSIMs requires an eSIM-compatible device. It is your responsibility to verify your device's compatibility before any purchase. Simio cannot be held responsible for any incompatibility of your device with eSIM technology.
5. Pricing and Payment
Plan prices are displayed in euros (EUR) and include all applicable taxes. Payment is made at the time of order through the offered payment methods (credit card, Apple Pay, Google Pay), processed securely by our provider Stripe.
Payment is charged immediately upon order confirmation. Once payment is confirmed, your eSIM is made available in your personal space.
6. eSIM Activation and Use
After purchase, a QR code and/or activation code are provided. You are responsible for the correct installation of the eSIM on your device. Each eSIM is associated with a data plan with defined volume and validity period.
The validity period begins upon first connection to the network in the destination country. Unused data at plan expiration is lost and does not entitle a refund.
7. Right of Withdrawal and Refund
In accordance with consumer protection laws, the right of withdrawal does not apply to digital content provided on an intangible medium whose execution has begun with your consent.
However, if your eSIM has not yet been activated (QR code not scanned), you may request a refund by contacting our customer service within 14 days of purchase.
8. Liability
- Simio commits to providing the Service with diligence but does not guarantee uninterrupted availability of the Service or network coverage.
- Connection quality depends on local partner operators and network conditions in the destination country.
- Simio cannot be held liable for indirect damages related to the use of the Service.
9. Intellectual Property
All elements of the Service (brand, logo, interface, content, source code) are protected by intellectual property law. Any unauthorized reproduction or use is prohibited.
10. Account Deletion
You may delete your account at any time from the application settings. Deletion results in the loss of access to your active eSIMs and history. Data is deleted in accordance with our privacy policy.
11. Changes to ToS
Simio reserves the right to modify these ToS. In case of substantial changes, you will be notified by email or notification. Continued use of the Service after modification constitutes acceptance of the new ToS.
12. Applicable Law and Disputes
These ToS are governed by French law. In case of dispute, the parties agree to seek an amicable solution. Failing that, the French courts shall have jurisdiction.
